Art. 1 – General Provisions

Art. 2 – Subject
- These General Terms and Conditions of Sale govern the offer, submission, and acceptance of purchase orders for products on pasol.info and do not govern the supply of services or sales of products by third parties linked to the site through links, banners, or other hyperlinks.
- Before ordering and purchasing products or services from third parties, users are advised to verify their sales conditions.
Art. 3 – Conclusion of the Contract
- To conclude the purchase contract, the electronic order form must be completed and submitted following the provided instructions.
- The form includes reference to the General Terms and Conditions of Sale, images and prices of each product, available payment methods, delivery terms and shipping costs, and the withdrawal rights including return procedures and timelines.
- Before concluding the contract, users will be asked to confirm they have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and personal data processing.
- The contract is concluded when the seller receives the correctly completed form from the user.

Art. 5 – Product Availability
- Product availability refers to actual stock at the time the buyer places the order and should be considered indicative only due to multiple users potentially ordering simultaneously.
- Partial or total unavailability may occur even after order confirmation. In such cases, unavailable items will be automatically removed from the order, and the buyer will be notified by email.
- If the buyer cancels the order, thus terminating the contract, pasol.info will refund the amount paid within 15 days of becoming aware of the buyer’s decision.

Art. 7 – Payment Methods and Prices
- Product prices are those displayed on the site at the time of purchase, except in case of obvious error.
- If an error occurs, pasol.info will promptly notify the buyer to allow order confirmation at the correct price or cancellation. pasol.info is not obligated to sell at an erroneously lower price.
- Prices include VAT but exclude shipping costs. Prices may change at any time but not for orders already confirmed.
- After selecting desired products, they are added to the cart. Users follow purchase instructions and can modify order details before payment.

Art. 8 – Delivery
- pasol.info ships throughout Italy, excluding Vatican City and San Marino.
- Delivery is made only to the address provided by the user at purchase.
- Delivery in Italy generally occurs within 1-3 business days, or within the estimated time indicated during shipping selection, and in any case no later than 30 days from order confirmation.
- Delivery to EU countries takes 4-8 business days, and no later than 30 days.
- If delivery is not possible, the order will be sent to a depot, and the user will be notified with instructions to arrange redelivery.
- If the user cannot be present at the agreed delivery time, they should contact pasol.info to arrange a new date.
- If delivery fails for reasons not attributable to pasol.info after 30 days, the contract is considered terminated.
- Upon termination, amounts paid including shipping (except additional costs from choosing non-standard delivery methods) will be refunded without undue delay and within 20 days of contract termination. Return shipping costs may apply.
- Shipping costs are borne by the buyer and clearly indicated at order time.
Art. 9 – Transfer of Risk
- Risk passes to the buyer upon delivery. Ownership transfers upon full payment of price and shipping costs or at delivery if later.
Art. 10 – Warranty and Commercial Compliance
- The seller is liable for product defects, including non-conformity with the ordered items, under Italian law.
- For consumers (individuals acting outside business/professional purposes), the warranty applies if defects appear within 24 months from delivery, with formal complaint within 2 months of defect discovery and correct online return form submission.
- Consumers may obtain free repair, replacement, price reduction, or contract termination and refund for defective products.
- Return shipping costs for defective products are borne by the seller.
Art. 11 – Withdrawal (Right of Cancellation)
- Buyers have the right to withdraw from purchase without penalty and without reason within 14 days from product receipt, per Art. 57 of Legislative Decree 206/2005.
- For multiple deliveries in one order, the 14 days start from the last product’s receipt.
- To exercise withdrawal or size exchange, buyers must email pasol@applika.info with order number and user name.
- Withdrawal requires explicit statement of decision or submission of the standard withdrawal form (optional).
- Return shipping costs for withdrawal or size exchanges are borne by the consumer.
- Size exchanges are allowed within 30 days from receipt; return shipping costs are borne by the consumer.
- Returned goods must be intact, in original packaging, complete, and with accompanying fiscal documents. The site may verify these conditions before refunding within 14 days. Refund includes purchase price and initial shipping.
- Refund may be suspended until receipt of goods or proof of shipment.
- Withdrawal does not apply to services or products excluded under Art. 59 of Legislative Decree 206/2005.
- Refunds use the same payment method. For bank transfers, buyers must provide IBAN, SWIFT, and BIC.
Art. 12 – Data Processing
- Buyer data is processed in compliance with data protection laws as detailed in the privacy policy according to EU Regulation 2016/679 (GDPR).
Art. 13 – Severability Clause
- If any provision is invalid for any reason, it will not affect the validity or enforceability of the remaining provisions.

Article 15 – Governing Law and Jurisdiction
- These General Terms and Conditions of Sale are governed by and construed in accordance with Italian law, except for any mandatory provisions applicable in the buyer’s country of habitual residence. Accordingly, the interpretation, execution, and enforcement of these General Terms and Conditions of Sale shall be subject exclusively to Italian law.
- Any disputes arising from or related to these Terms and Conditions shall be resolved exclusively by the Italian courts. However, if the buyer qualifies as a Consumer, any disputes shall be resolved by the court of the buyer’s place of domicile or residence, according to the applicable law.
